Road traffic accident claim settled for £5,000 – almost three times initial offer

Our client was injured in a road traffic accident after another driver failed to stop at a junction, causing a collision.

Although the injuries were not life‑threatening, they had a real impact on everyday life, work, and wellbeing. From the outset, the insurer disputed the extent of the injuries, as well as liability. They made a low initial offer of £1,750.

The incident occurred when our client was driving through a green traffic light. Another motorist approached from the side and drove through the junction without stopping, striking our client’s vehicle. The crash caused soft‑tissue injuries, primarily to the shoulder.

Our client sought medical advice shortly after the accident and followed recommended treatment. Although symptoms eased over time, they continued to experience ongoing pain and restrictions during the first year.

Despite the insurer’s attempts to minimise the claim, our team gathered:

  • A clear statement of events, demonstrating that our client was not at fault
  • Expert evidence showing the connection between the accident and the period of ongoing discomfort

The insurer refused to increase their offer beyond £1,750 during early negotiations. As a result, we raised court proceedings and prepared the case thoroughly, ensuring we were ready to represent our client at a hearing.

Once the defender reviewed the full evidence, including the medical report and the strength of our liability case, they reconsidered their position. Shortly before the matter was due to call in court, the insurer increased their offer.

Settlement

The case settled for £5,000, almost three times the original offer. This avoided the stress of a court hearing while still securing fair compensation for our client.
