The Pursuer was a passenger in a vehicle travelling through the car park at Nerston Industrial Estate, East Kilbride, when a collision occurred. The incident took place around midday, as the vehicle in which the Pursuer was travelling approached the exit. Another driver suddenly emerged from a junction to the left and collided with the nearside of the Pursuer’s vehicle. The collision was unavoidable for the Pursuer’s driver, who was proceeding correctly at the time.

As a result of the accident, the Pursuer suffered soft tissue injuries to her neck, lower back, and left ankle. She required medical attention at University Hospital Hairmyres and was unable to attend work as a nurse, resulting in a loss of earnings.
We gathered evidence to demonstrate the impact of the injuries, including medical records and wage loss documentation. The claim was presented under several heads: solatium (compensation for pain and suffering), wage loss, and miscellaneous expenses. The case was advanced based on the clear fault of the other driver, who failed to keep a proper lookout and did not exercise reasonable care for other road users.
Settlement
Due to no response from the third-party insurer during pre-litigation discussions, a Court action was raised to progress matters. After raising the claim in Court, the Pursuer was able to secure a four-figure settlement reflecting the pain, suffering, wage loss, and inconvenience experienced as a result of the accident.
