We acted on behalf of our client who was a passenger of a vehicle involved in a head on collision near Dumfries.
As a result of this collision, our client suffered a number of severe injuries which were both physical and psychological. Particularly, our client suffered a severe head injury which led to a number of ongoing cognitive problems which our client will have for the rest of his life.
How did we help our client to resolve his claim
We worked closely with our client and a number of medical experts in different disciplines to ensure we had a very good understanding of all aspects of his injuries. Given the severity of the injuries, it was extremely important for us to get a complete picture of both the extent of the injuries he sustained in the accident and his long-term prognosis.
Our client is a young man who is self-employed and so his loss of earnings claim was complex. We required to obtain input from a forensic accountant to advice on his past and future loss. This calculation was complicated furhter by the fact that he had reduced cognitive abilities because of the head injury he had sustained so a number of roles were not ones suitable for him.
We were concerned that our client was not receiving the appropriate treatment for his injuries so we spent some time liaising with a number of those medical practitioners treating him to assist in him being referred for specific and specialist treatment as quickly as possible.
Having obtained all the information, we required to raise a court action against both the driver of the vehicle our client was travelling in and the driver of a second vehicle which was also involved in the accident. Both drivers were blaming each other.
We were able to negotiate a settlement of our client's claim. To do so, we worked collaboratively with the solicitors acting on behalf of the insurers for the respective drivers. As it was very important to ensure that any settlement took account of our client's future requirements for care and lost revenue we needed to update a number of expert reports very shortly before finalising the deal.
Settlement
We obtained a settlement of £285,000 for our client.
