Our client was initially involved in a rear end shunt in which liability was fully admitted. Whilst we were instructing our independent medical evidence our client was unfortunately involved in a second road traffic accident.
The second accident exacerbated our client’s injuries from the first accident. We therefore instructed an orthopaedic consultant to examine our client and asked if they could apportion a prognosis for each injury to each accident.
Our expert was able to do this and advised on a percentage basis of what each accident was responsible in terms of injuries.
Our client also required a report from a consultant psychiatrist in respect of her travel related anxiety. The psychiatrist was also able to apportion the percentage of injuries to each accident and recommended a course of CBT treatment to aid her recovery.
Upon presenting the medical evidence to the respective insurance companies for each accident, they agreed with what injuries each accident caused and offered the appropriate settlement to our client for each accident. The insurers were also able to instruct the CBT treatment for our client on a joint basis.
