Our client was involved in a road traffic accident whilst riding his motorcycle early one morning on his way to work.
Our client was established on a roundabout, when a car failed to give way and pulled straight on to the roundabout. Our client had to take evasive action in order to avoid a serious impact. However, he still sustained soft tissue injuries as well as damage to his motorcycle.
How we helped
We directed our claim directly to the insurers of the car. However, liability was initially denied due to the fact that a direct collision had not occurred between the vehicles. In taking statements from our client and the third party driver, we were able to establish from the driver of the car, that she had crossed the front of her car over the give way lines to enter the roundabout before she was aware of our client’s presence.
She confirmed that he would have already been established on the roundabout at this point. Based on this admission from the driver we were able to persuade the insurers of the car that their insured was responsible for the incident.
The insurers agreed on this basis to deal with our client’s claim on a without prejudice basis. We obtained a medical report from an Independent GP as well as instructing engineers to inspect our client’s motorcycle. After the engineering evidence and medical report were received they were disclosed to the insurers, and settlement for both losses was achieved shortly after.
