Psychological injuries can be caused by a traumatic event or series of events.

Did you know that you do not need to have been physically injured in an accident at work to make a claim for compensation?

If you have suffered a psychological/psychiatric injury the symptoms you may have suffered from could include anxiety, depression, low mood, or post-traumatic stress disorder (PTSD). If you have suffered from any such symptoms you can make a compensation claim. 

Your symptoms of psychological/psychiatric injury could range from flashbacks, nightmares, ruminating over the accident and what ifs, low mood, irritability, along with a number of other elements, including sleep disturbance. If you are suffering from any of these symptoms / or have suffered from such symptoms following an accident at work, you can make a claim even though there was no physical injury for example a burn or broken bone.

How do you value a claim for psychological injury?

In the same way as a report is obtained in relation to physical injuries, a report is instructed to comment on your psychological/psychiatric symptoms and the severity of these. Psychological injury claims are valued by reference to a psychological or psychiatric report prepared by an expert with the relevant expertise.  The expert would examine you and thereafter provide a report commenting on the psychological/psychiatric effects of the incident providing a prognosis for the recovery of your symptoms. 

The expert Psychologist/Psychiatrist would also confirm whether any treatment, such as Cognitive Behavioural Therapy or Eye Movement Desensitisation Reprogramming, was required to aid the recovery of your symptoms.

Is it worth pursuing a claim?

If you have suffered psychological trauma following an accident in your place of work, it is certainly worth pursuing a claim.  You do not need to have physical injuries in conjunction with psychological/psychiatric symptoms to pursue a claim. A claim can be made regardless.
