An acquired brain injury can be catastrophic for not only the victim, but it can also significantly alter the lives of all members of the family, particularly if the victim is a child. The immediate effect of such an injury will be traumatic, requiring adjustment to the change in circumstances in a short space of time, and dealing with a range of emotional, practical and legal issues.

We understand that making a claim is a very personal experience and that you may be uncertain of what is involved, especially when the injuries sustained have been so life changing for all members of the family. Our team strive to build relationships based on trust and mutual understanding, so that you feel comfortable and confident going forward with your case.

How we can help

Serious injury claims such as a brain injury, understandably attract higher levels of award than other types of personal injury. Compensation will be available for not just the pain and suffering but also past and future financial loss. There may, for example, be changes to the practical circumstances of how the family functions to consider, such as the cost and upheaval of changes to the family home, or even having to move to more suitable accommodation.

Whatever the individual circumstances, we will seek to obtain the maximum amount that you are entitled to and obtain interim payments, wherever possible, for rehabilitation or care. As part of a full-service practice, we can also advise on other legal aspects such as, for example, setting up a personal injury trust, which may be the best option to protect a large compensation payment.

An injured child's behaviour can become difficult, which will compound anxieties about how other children within the family unit may be coping with the inevitable changes to family life. We can provide practical support, such as assistance with access to support groups, needed to adjust to changed circumstances.

Legal proceedings

Making a claim is a unique experience for those involved which can be daunting without the right support. We aim to develop the relationship so that you feel comfortable and confident with the process. Our priority is to reach the best possible settlement as soon as possible, preferably with a negotiated settlement out of court.

Sometimes, however, the circumstances of an acquired brain injury result in legal proceedings. Victims and their families will need substantial levels of support during these proceedings.

Throughout the period the family may need assistance in arranging care, therapy and rehabilitation for the victim or even dealing with the media. A large number of medical expert witnesses may need to be instructed as well as employment consultants, actuaries and architects.

An example of the above can be illustrated by a case in which we acted for a child who sustained life-changing injuries, including severe traumatic brain injury, after being involved in a road traffic collision. As a result, the child was left unable to cope with any form of independence, requiring constant care and supervision. The case went to court and throughout that time we assisted our client and his family by arranging care, therapy and rehabilitation. The case was eventually settled for £8.5 million with a significant element of the award being for future care.
