The Logie Housing Estate in Dundee was completed in about 1920, with an estimated 250 properties on the scheme. The houses were built by the then Local Authority. Ownership of the estate passed to Dundee City Council (DCC). Asbestos was used in the construction of the houses on the estate amongst other things as a fire retardant. Until very recently DCC had not disclosed to the tenants, occupiers or purchasers of houses on the estate that they contained potentially harmful asbestos. DCC has now started a programme to remove the asbestos.
Tenants/Occupiers
Those currently living in affected homes will have to be rehoused while the asbestos is removed. As well as suffering inconvenience and expense, there is also the risk they may have become exposed to asbestos. Following exposure to asbestos, symptoms do not appear for many years and many residents may be concerned that, if they have been exposed, this could lead to them developing an asbestos related disease.
Buyers of affected homes
Depending on the circumstances of sale, DCC may be liable for their failure to make buyers aware of the presence of asbestos in the house. In that event buyers may have claims for the loss in value of their home because of the asbestos, together with the costs of its removal and living in temporary accommodation during removal.
