Cosmetic surgery negligence can happen when a medical professional involved in the procedure does not give their patient the appropriate level of care, and this results in harm or injury.

This can be the result of a number of factors such as misdiagnosis, surgical errors, and a lack of informed consent.

Examples of cosmetic surgery negligence include:

  • Performing the incorrect procedure
  • Leaving surgical instruments inside the patient's body
  • Making improper incisions or cuts
  • Neglecting to manage postoperative care appropriately
  • Failing to identify underlying medical conditions that could increase the risk of complications

If you believe you have suffered harm as a result of cosmetic surgery, you should seek legal advice as soon as possible. We will be able to help you determine if you have a case and, if we believe you do, will guide you through the process of making a claim for compensation.

In order to make a successful claim, you must be able to demonstrate that the action taken by the cosmetic surgeon fell below the standard of care of a competent medical professional and that this failure resulted in your injury or harm.

In the United Kingdom, cosmetic procedures are regulated by the Medicines and Healthcare products Regulatory Agency (MHRA) and the General Medical Council (GMC). The MHRA is responsible for ensuring that medical devices used in cosmetic procedures are safe and perform as intended, while the GMC sets standards for medical professionals who perform these procedures.

In addition, some cosmetic procedures may be subject to regulations under the Human Tissue (Scotland) Act 2006  and the Human Fertilisation and Embryology (Scotland) Act 1990 which governs procedures related to fertility treatment and embryo research.

Overall, the aim of these regulations is to protect the health and safety of individuals who undergo cosmetic procedures and to ensure that qualified and experienced practitioners perform these procedures. Practitioners who fail to comply with these regulations may face penalties, including fines, suspension, or revocation of their license to practice, or criminal prosecution.
