Hospital acquired infection claims against hospitals

In the past ten years, hospital infections have fallen dramatically, with a thirty-seven per cent reduction in levels of MRSA and a seventy-eight per cent reduction in the C. difficile infection being contracted by patients aged over 65. However, these infections still frequently take hold in hospital wards and can have a severe impact on those infected. If you have acquired an infection in hospital, we can help.

What is a hospital-acquired infection?

Hospital acquired infections have been brought to the spotlight recently, with many several cases arising in hospitals in Scotland.

Healthcare Associated Infections (HCAIs) are infections that develop as a direct result of intervention of some sort while a patient in a hospital or other healthcare facility. Healthcare environments may include GP's, dentist surgeries or care homes.

The most common HAIs that we deal with include:

  • Staphylococcus aureus (MRSA or MSSA)
  • Clostridium difficile infection (C.diff)
  • Escherichia coli
  • Pseudomonas aeruginosa
  • Bacteraemia
  • Gram-negative bacteria
  • Klebsiella species
  • Surgical site infection

Can I make a claim against a hospital for a hospital-acquired infection?

To make a claim against a hospital for contracting an infection, there are certain things that you must be able to prove, Our lawyers can help you make a strong case, and provide the evidence required to support your claim. You must be able to demonstrate:

  • the infection was contracted in the hospital where you were staying
  • the treatment from the hospital fell below an acceptable standard
  • that if the treatment you had received in the hospital had not fallen below an acceptable standard, you would not have contracted the infection
  • that the negligence on the part of the hospital and medical staff resulted in your injury and subsequent loss

Helping real people make successful claims

An example of how Calio Claims can help you make your claim can be illustrated by a case in which we acted for the family of an elderly victim who contracted C. diff following an admission to Ninewells Hospital in Dundee. The victim died as a result of the infection and despite their efforts, the family received no remedy from a complaint to the Health Authority.

After being instructed by the family, we initiated a claim against the Health Authority to obtain justice for the victim. We gathered expert opinions from medical professionals both of whom determined the Health Authority were at fault. Before going to court, the Health Authority agreed to settle the claim for £30,000. As well as the financial compensation the family received, we supported them throughout the claim , ensuring they were kept up to date each step of the way.
