Where you have been injured whilst riding, or by an e-scooter as a pedestrian, you may be able to bring compensation against the rider or driver.

E-Scooters are a relatively new phenomenon to the law. Perhaps most like e-bicycles, they differ in that they are currently illegal to use on public roads and pavements. So, what does the law currently say?

Previous cases of e-scooter accidents that have made their way through the Courts are few and far between. Despite being in uncharted territory, there are some legal principles we can apply to e-scooter.

If you fail to wear a helmet whilst riding, or are intoxicated for example, you will likely find that any award of potential damages would be subject to a contributory negligence discount.

If an e-scooter accident does occur, always try your best to get the third-party driver/rider details, which include insurance details. 

It is important to note if you are involved in an accident with a pedestrian, e-scooter, or e-bicycle you may be able to claim against the home insurance of the third party. Always ask for this at the scene as it may be difficult to ascertain.

Photographs always help but it is understandable that this may not be achievable. Make sure you are in a safe position, away from the danger of other vehicles at a point of priority.

You should then seek medical assistance if required, whether that be a call to 999 for an ambulance or a trip to Accident and Emergency. If Police are required, they should be contacted too at the scene.
