Potholes are one of the most common pet hates for all drivers in the country. Road and pavement defects do not stop at potholes, they can also include hazards such as raised manhole covers or drains.

Liability

Local Authorities have a duty to maintain roads under the Roads (Scotland) Act 1984 and action any defects that are a risk to the public.

What should you do if you suffer an injury due to a road or pavement defect?

  • contact your local council and report the defect
  • measure the defect
  • take pictures of the defect with the measurement in the picture (you can use a coin next to the defect)
  • call a personal injury solicitor who specialises in claims involving road defects.
