Psychological injuries can be caused by a traumatic event, series of events.

If you are involved in a road traffic accident and did not sustain any physical injuries but are suffering from psychological side effects as a result of the incident, then you may be able to claim compensation.

Psychological injuries arising from a road traffic accident can include anxiety, depression, low mood, or post-traumatic stress disorder (PTSD).

Symptoms of psychological injury could range from flashbacks, nightmares, ruminating over the accident and what ifs, low mood, irritability, along with a number of other elements, including sleep disturbance. 

If you suffer from any of these symptoms following a road traffic accident you could make a claim for compensation even if you have not suffered a physical injury such as whiplash or a soft tissue injury.  

How do you value a claim for psychological injury?

Psychological injury claims are valued by obtaining a report from a psychological or psychiatric expert.  The expert would examine you and thereafter provide a report commenting on the psychological effects of the incident and comment on a prognosis for the recovery of your symptoms. 

The expert would also recommend any treatment, such as Cognitive Behavioural Therapy or Eye Movement Desensitisation Reprogramming, which is most commonly used to treat PTSD if they feel that this would help in the recovery process. 

Is it worth pursuing a claim?

If you have suffered psychological trauma through a road traffic accident, it is certainly worth pursuing a claim.  You do not need to have physical injuries in conjunction with psychological symptoms to pursue a claim. A claim can be made regardless.
