When you have been involved in an accident, the insurers of whoever is responsible may contact you directly and make you a pre-medical offer to settle your claim.

What is a pre-medical offer?

A pre-medical offer is a settlement offer made without any medical evidence or medical report to state what injuries you suffered and more importantly what the prognosis is for these injuries.

Why do insurers make pre-medical offfers?

To save money. Medical reports can be expensive and so the insurers want to avoid paying for the cost if they can. Also, by dealing directly with you, the insurers want to avoid having to pay any legal costs.

It is also important to note that by making an offer, it means that the insurers of the at fault party have accepted responsibility for the accident, and are willing to deal with your claim.

What is wrong with a pre-medical offer?

You never know how serious an injury is or what the prognosis will be until you have a medical report. You only get one shot at settling a compensation claim and if you accept a pre-medical offer and then find out that your injury does not resolve as quickly as you thought, then you cannot claim compensation a second time. 

It is therefore vital to seek independent legal advice and obtain medical evidence and ensure that you get it right the first time.

Are pre-medical offers legal?

Yes, but there are moves in England to have them banned and it is likely that Scotland may follow suit. Until they are banned though you should never accept a pre-medical offer. If you do, you could end up with a lot less compensation than you deserve.
