The majority of treatment provided in hospitals throughout Scotland is of a very good standard. Yet, mistakes can be made by medical professionals treating patients and they can lead to further complications or injury.  

It was reported earlier this year, that NHS Scotland has paid out more than £350m over the past ten years in relation to medical negligence claims with £200m of that being paid out over the past five years.  

Claims for negligent GP treatment 

GP’s are responsible for their own actions, and some examples of negligence include: 

  • failing to refer to a hospital or a specialist for further investigation into symptoms 
  • failing to act upon test results 
  • failing to diagnose illness or injury correctly 
  • prescribing the incorrect medication

Mistakes during surgery 

Doctors and surgeons have a duty of care to their patients to ensure that they are aware of any risks involved in any recommended surgical treatment. Patients should always be told of alternative treatments available to them and be advised of the benefits and dangers, so they can make an informed decision about their treatment.  

If a surgeon fails to explain all the reasonable treatment options available (and the pros and cons) then they are liable for a hospital negligence claim if something goes wrong.
